Who to call first about the sewer lateral

Who is responsible for which part
The lateral is the property owner's outright - expressly including the run across public rights-of-way and the connection into the city main - and the code says it is not part of the public sewer system.
- The property owner
- The City states that "the private sewer laterals are the property of the property owner and are not part of the public sewer system", and that "nothing in this chapter shall be interpreted as changing the private nature of the private sewer laterals". Its definition runs that lateral "from the plumbing of a building to a public sewer collection line, including portions that extend across public rights-of-way and the Saddle, wye or other physical connection to the collection line" - so the run beneath the street and the fitting at the city's main are both the owner's. The owner must, at their own expense, "inspect, maintain in good working order, repair and replace, as necessary" that lateral. The City says the same in its sewer system management plan, twice and without hedging: "the property owner is fully responsible for installation, maintenance, and repair of the parcel private sewer lateral(s)", and "the City has no responsibility for the installation, maintenance, operation, repair or replacement of private sewer laterals (PSL) connected to the City mains".

City of Morgan Hill Ordinance No. 2322, New Series, amending chapter 13.20 of the Municipal Code (adopted 2 June 2021)What the rules say
Most relevant if you are selling or buying
Morgan Hill Municipal Code 13.20.070 states that residential, commercial and industrial buildings must have the private sewer lateral inspected by a qualified contractor before a sale, that any repairs the City requires must be completed, and that the seller is responsible for obtaining a Compliance Certificate for Private Sewer Lateral before the sale concludes. The City states it issues the certificate within five business days once compliance is verified.
What to do: Ask the City of Morgan Hill whether a Compliance Certificate is already on file for this property. If an inspection finds defects, the code lets a seller and buyer agree in writing to transfer responsibility for the repairs to the buyer, who then has one hundred eighty days from the sale to complete them.
City of Morgan Hill Ordinance No. 2322, New SeriesWhy this matters
The City's public summary says the requirement applies to properties more than fifteen years old. The ordinance is narrower about what the fifteen years measures: 13.20.070(H) exempts a property where the lateral itself was built or completely replaced within fifteen years of the sale, not where the house was. It also exempts a lateral inspected to city standards within the last ten years, a transfer excluded from property tax reassessment, and a single-family unit on a shared private collection system. Which of these you fall under depends on the lateral itself, which no address lookup can see.
Assistance programmes
City of Morgan Hill private sewer lateral grant
50% of the lowest contractor bid, up to $5,000. Apply first: the City states that a Letter of Approval must be received "BEFORE any construction work begins", and that "all sewer lateral construction work done before grant approval is ineligible for funding". The clock then runs from approval: "Once the Letter of Approval is issued, you will have 90 days to complete the project, pay the contractor, and request grant payment". The application needs a contractor's inspection report and CCTV footage - the owner hires a contractor to "record CCTV footage of the pipeline" - and "Each property can receive a maximum of one private sewer lateral grant in a 20-year period".
The City is accepting applications for the 2026-27 financial year, with funds distributed first-come, first-served. Permits are required from the Building Division for work on private property, or from the Engineering Department for work in the public right of way.

Your other pipe: the water service line
The drinking water line coming into your property is a separate pipe, run by a separate authority, and who is responsible for it is decided separately. Your sewer lateral is yours to the main, fitting included; your water line stops being yours at the meter.
