Who is responsible for which part

The lateral is the property owner's outright - expressly including the run across public rights-of-way and the connection into the city main - and the code says it is not part of the public sewer system.

The property owner

The City states that "the private sewer laterals are the property of the property owner and are not part of the public sewer system", and that "nothing in this chapter shall be interpreted as changing the private nature of the private sewer laterals". Its definition runs that lateral "from the plumbing of a building to a public sewer collection line, including portions that extend across public rights-of-way and the Saddle, wye or other physical connection to the collection line" - so the run beneath the street and the fitting at the city's main are both the owner's. The owner must, at their own expense, "inspect, maintain in good working order, repair and replace, as necessary" that lateral. The City says the same in its sewer system management plan, twice and without hedging: "the property owner is fully responsible for installation, maintenance, and repair of the parcel private sewer lateral(s)", and "the City has no responsibility for the installation, maintenance, operation, repair or replacement of private sewer laterals (PSL) connected to the City mains".

And there is a duty here that has nothing to do with a blockage: the same plan records that "the City Council has adopted a new proactive sewer lateral inspection program that will become effective on June 1, 2022", and that "this program requires private lateral owners to inspect laterals based upon defined criteria in the lateral ordinance available on the City website". So in Morgan Hill you may be required to inspect your lateral whether or not anything is wrong with it. The criteria are in the lateral ordinance rather than in the plan, so ask the City which of them apply to your property.

  Morgan Hill Municipal Code 13.20.070 states that residential, commercial and industrial buildings must have the private sewer lateral inspected by a qualified contractor before a sale, that any repairs the City requires must be completed, and that the seller is responsible for obtaining a Compliance Certificate for Private Sewer Lateral before the sale concludes. The City states it issues the certificate within five business days once compliance is verified.

  What to do: Ask the City of Morgan Hill whether a Compliance Certificate is already on file for this property. If an inspection finds defects, the code lets a seller and buyer agree in writing to transfer responsibility for the repairs to the buyer, who then has one hundred eighty days from the sale to complete them.

The ordinance is narrower about what the fifteen years measures: 13.20.070(H) exempts a property where the lateral itself was built or completely replaced within fifteen years of the sale, not where the house was. It also exempts a lateral inspected to city standards within the last ten years, a transfer excluded from property tax reassessment, and a single-family unit on a shared private collection system. Which of these you fall under depends on the lateral itself, which no address lookup can see.
