Buying or selling?
Pinole requires the building sewer lateral to be cleaned and inspected before a sale closes, for property connected to the City's sewer. Section 13.20.050 lists among the events that require it: "Prior to the close of escrow upon a sale or other transfer of the house, building, property or other structure served or, if there is no escrow, prior to recording a deed or other document transferring title to the house, building, property or other structure served."

Who is responsible for which part
On the City of Pinole's sewer, the building sewer lateral is the owner's all the way to the City's main, including the length under the street. Chapter 13.20 of the City's code makes it "unlawful for any property owner to maintain a building sewer lateral in a defective condition" and provides that "All costs of repair or replacement of the building sewer lateral shall be borne by the property owner." The City's lateral page says: "The maintenance and repair of the entire private sanitary sewer lateral is the responsibility of the property owner." West County Wastewater District collects in some sectors of the city instead, under its own rules.
- The property owner
- The whole building sewer lateral, from the building to the City's main. Section 13.20.020 defines it as "That part of a drainage system which extends from the end of the building drain and conveys discharge to a public sewer or other point of disposal", and adds: "The building sewer lateral shall terminate at the wye or other manufactured connection to the public sewer." The same section provides that "That portion of the building sewer lateral which may lie within any public street or right-of-way is not a public sewer in the city." The City's 2022 Sewer System Management Plan says: "The City does not own or maintain any portions of the sewer laterals."

What is required
Pinole requires the building sewer lateral to be cleaned and inspected before a sale closes, for property connected to the City's sewer. Section 13.20.050 lists among the events that require it: "Prior to the close of escrow upon a sale or other transfer of the house, building, property or other structure served or, if there is no escrow, prior to recording a deed or other document transferring title to the house, building, property or other structure served."
What to do: If you are selling a Pinole property on the City's sewer, check for a certificate of compliance issued in the last ten years; if there is none, have a licensed contractor clean and video the lateral, give the City at least seven days' notice, and allow time for any repairs before escrow is due to close.
Pinole Municipal Code section 13.20.050Why this matters
The inspection is by video, made by a contractor with "both a city of Pinole business license and a State of California contractor's license", and the owner "shall notify the city of the time and date of the Inspection at least seven (7) calendar days prior to the inspection." A lateral that fails must be repaired at the owner's cost and inspected again; one that passes gets a certificate of compliance and needs no new test for ten years unless the City has reason to believe it is defective. A transfer between family members or into a living trust is exempt where the County Assessor does not require a reassessment, and the code exempts buildings "built within ten (10) years or less of the enactment of this chapter" and laterals replaced within ten years of the sale. The Public Works Director may defer repairs for up to 180 days for undue hardship. The requirement is the City's: in the sectors West County Wastewater District serves, its own certificate of compliance applies instead.
