Who pays for the sewer lateral in Palo Alto, CA

Which part of the pipe is yours

If something’s wrong

If a repair needs a permit or an inspection

  • Any time · Work required

Palo Alto puts two duties on every customer, and the first one decides how much pipe is yours. Rule and Regulation 23 requires "keeping the Sewer Cleanout boxes visible and accessible" - and the same regulation gives the City a share of the lateral only where a City Sewer Cleanout is present and accessible, so a buried or blocked one leaves you owning "the entire Sewer Lateral between the City's Wastewater Main and the building being served on the Premises". The second duty is "installing an approved backwater valve in accordance with the latest adopted version of the California Plumbing Code", to protect fixtures on "floor levels that are considered ground level or lower".

  • When you remodel · Work required

Building work in Palo Alto can put the utility's own side of both pipes on your bill. For water, Rule and Regulation 21 makes the customer responsible for replacing a service of 2 inches or smaller that is "not polyethylene or copper when building a new structure or constructing additions/remodels that have a value greater than $200,000 for residential projects or greater than $300,000 for commercial projects" - and the replacement runs "from the main up to and including the Water Meter box". For sewer, Rule and Regulation 23 provides that where a project forces the lower lateral to be "realigned and reconnected to the Wastewater Main at a new location", the customer pays "the cost of replacing the Lower Sewer Lateral from the Wastewater Main up to and including the City's Sewer Cleanout, and for installing a City Sewer Cleanout if one was not present".

Who is responsible for which part

It depends on whether you have a City sewer cleanout, and where it is. With one, Palo Alto owns and maintains the lateral "from the Wastewater Main up to and including the first City Sewer Cleanout" and you own the rest to your building. Without one - or if it is inaccessible, or if the cleanout is yours and sits "more than 5 feet behind the property line" - you own "the entire Sewer Lateral between the City's Wastewater Main and the building".

What to do: Find out whether there is a City sewer cleanout on your lateral and whether it is clear - it is usually in the planting strip between the pavement and the road. If there is not one, ask City of Palo Alto Utilities on 650-566-4501 whether it will install one, because the regulation says that once it is in and working the City owns the lateral from the main up to it. Then ask your plumber whether the fixtures on your lowest floor are protected by a backwater valve.

What to do: Before the plans are final, ask two questions of City of Palo Alto Utilities on 650-566-4501. First, what material and size your existing water service is - if it is 2 inches or smaller and is not polyethylene or copper, and the project value is over the threshold, replacing it from the main to the meter box is yours. Second, whether the project will require the lower sewer lateral to be realigned to a new connection at the main. Get both answers in writing and put them in the budget rather than discovering them at inspection.
