Who is responsible for which part

The property owner maintains the whole lateral to the City main, expressly including the run within the right-of-way and the fitting where it branches off the main.

The City states that "the owner of a sewer lateral is responsible for maintaining their sewer lateral all the way to the City main, including the portion within the right-of-way", and that "this includes the fitting that branches the lateral off the main". Its Sewer System Management Plan instructs first responders that "response and repair of private laterals is not the City's responsibility". The City maintains its own mains, two pump stations and its forcemain, and no part of the lateral. The section the City is citing is Municipal Code 17.04.270, and it goes further than the help page does: under the heading "Ownership, Maintenance and Repair of Private Sewer Laterals", it provides that "private sewer laterals shall be owned, maintained and repaired by the owner of the property, which the lateral serves", and that the whole of it, from the building connection out to and including the wye at the sewer main, "shall fall within the owner's responsibility". So the pipe is yours by title as well as by upkeep.

  The City of Mill Valley requires a private sewer lateral inspection when a property is sold. The same ordinance also requires one for building permits totalling $50,000 or more over three years, after a sewage overflow or malfunction, and when the City repaves the road above a lateral.

  What to do: Check whether the lateral was installed, fully replaced or repaired recently enough to be exempt before arranging an inspection with the City of Mill Valley.

  The exemption is wide and most owners of a newer line will meet it: the City states a lateral "is exempt if you provide proof that the line was originally installed or fully replaced within the last 20 years or that it has been repaired within the last three years". Where an inspection is needed the City's fee is $439.24. Note the permit threshold is cumulative over three years, so two modest projects can reach it where neither would alone.

  Confirm before relying on this. The larger grants are written for replacements required by the agency's own capital improvement work - the street being dug up - rather than for a lateral that failed a point-of-sale inspection, which is the more common reason to be reading this. Whether a particular job qualifies is a question only SASM can answer, and it is worth asking before assuming the $2,000 or $7,500 applies. The $200 inspection grant carries no such condition.

  Up to 20% of the cost of the work, capped at $2,000. For households earning 80% or less of Median Family Income, up to 75% of the cost, capped at $7,500. Separately, up to $200 towards a CCTV inspection. SASM states that "the cap amount may change depending on availability of the remaining fund".

  The Sewerage Agency of Southern Marin states the reimbursement is for "Residents who were required to replace their sewer laterals as a result of SASM or a member Agency's capital improvement program". A separate grant "of up to $200 to reimburse private sewer lateral inspection performed by CCTV" is stated without that condition. Participants "must receive a Certificate of Compliance from your district upon completion of the project - a building permit does not satisfy this requirement".
