Who is responsible for which part

Larkspur is split between two sanitary districts, and if your lateral is your own it does not matter which one you are in: Ross Valley Sanitary District and Sanitary District No. 2 of Marin County both say the property owner has the whole lateral, including the connection to the sewer main. If your lateral is shared with another property it matters a great deal, because the two districts divide a shared pipe differently.

The property owner

The whole lateral, on both districts' own ordinances. Ross Valley Sanitary District states that private sewer laterals "shall be owned, maintained and repaired by the Owner(s) of the property served", covering the entire lateral "from the building connection to and including the 'wye' connection or other-tie-in to the Sewer Main". Sanitary District No. 2 of Marin County defines both halves as parts of one "private sewer lateral", with the lower lateral running to the sewer main and including its connection to it. Ross Valley adds that the owner's responsibility "may extend to where the lateral crosses onto another property, regardless of whether a recorded easement exists".

What else is worth knowing

Find out whether your lateral is shared with another property, because that is where the two districts part company. Ross Valley Sanitary District divides a shared run by position: each owner keeps their portion "up to the next downstream lateral connection", and the household with "the furthest downstream lateral connection" carries "the remaining portion of the lateral, including its connection to the public sewer main" - so the house nearest the street can face the whole cost of opening the road on behalf of every property above it. Sanitary District No. 2 of Marin County instead has a shared lateral repaired jointly by the owners of the residences it serves, and says nothing about position on the run. Which district serves your address therefore decides how a shared bill is split, and it also decides which permit you need, what it costs and what is required of you at a sale - none of which are the same between the two. Only the ownership answer survives not knowing.

  The City of Larkspur requires an encroachment permit under Municipal Code Title 15.32 for work in the public right-of-way, and its application names the job outright: under "EMERGENCY PERMIT FOR" the categories include "Water/Sewer Lateral Repair, Trenchless" and "Water/Sewer Lateral Repair, Open-Cut". The City states that "work being performed for utility agencies will require permit from applicable agency prior to issuance of City encroachment permit", so the sanitary district's permit comes first. Applicants must contact the Public Works Inspector "a minimum of 2 business days prior to the start of construction" and again at completion for a final inspection, carry $1,000,000 general liability with the City named as additionally insured, and call USA at 811 before excavating.

  What to do: Get the sanitary district's permit first - the City will not issue its own until you have it, and in Larkspur that means establishing whether Ross Valley Sanitary District or Sanitary District No. 2 of Marin County serves your address. Apply to the City through eTRAKiT, using the emergency category if the pipe has already failed, and say whether the work is trenchless or open-cut. Book the inspector two business days before work starts and again at completion. Then treat the sixth working day after the work finishes as the real deadline for final paving, not the ten- or fourteen-day figures, because that is when $300 a day begins. Ask your contractor to confirm $1 million general liability with the City named as additionally insured, and agree who is removing the USA markings - the permit holder has two months before the City removes them and bills the cost plus 20%.

  Three different deadlines govern putting the road back, and the one that costs money is the shortest. The application requires excavations to be "permanently surfaced within ten (10) calendar days after backfill is complete"; Standard Condition 9 allows restoration "no later than 14 days after completion of the work"; and the City's fee schedule imposes a "$300 PER DAY PENALTY FOR EACH DAY OF FAILURE TO COMPLETE FINAL PAVING OF TRENCHES IN THE STREET", running from "THE SIXTH WORKING DAY AFTER COMPLETION". Someone planning to the fourteen-day condition would be thousands of dollars down before the deadline they were working to arrived. Larkspur is also the only authority on this site that puts the two permits in order rather than leaving a homeowner to find the second one late - which matters here more than anywhere, because the town is split between two sanitary districts and the applicant must establish which one serves them before the City will issue anything. Note too that the City asks $1 million in liability cover where Ross, four miles away and sharing a sanitary district, asks $2 million.
