Who is responsible for which part

Unusually, the City pays for part of this pipe. The owner cleans and maintains the whole lateral from the house to the main, but reconstruction and repair of the street portion - beyond the first joint after the property line - is the City's - but the code makes that duty "subject to compliance with" its cleanout section, so the fitting is what the City's share rests on. A street-side blockage will usually be cleared by City crews, though the City calls that a courtesy rather than a duty. Part of Los Altos is served by Cupertino Sanitary District instead, which answers the same question its own way.

Los Altos

The reconstruction and repair of the street portion, conditionally, and no part of the cleaning. The code states that "the city shall be responsible for the reconstruction and repair of all lateral sewers subject to compliance with Section 10.04.250 of this article" - and 10.04.250 is the cleanout section, which requires a cleanout where the building sewer joins the lateral sewer, maintained watertight, under an approved box set flush with the ground. On its website the City puts the same split without the condition: it "is responsible for re-construction from the first joint after the property line to the main sewer line", and "is not responsible for any plumbing bills except when a street lateral requires reconstruction or repair". On a defect found during a blockage, "the City will repair it if the defect is beyond the first full section of pipe past the cleanout". Clearing a blockage is different: crews "will clear the stoppage as a courtesy if the blockage is between the property line cleanout (if accessible) and the main sewer line" - the City's own word is courtesy, so this is not a maintenance duty and should not be relied on as one.

The property owner

The cleaning and upkeep of all of it, and the reconstruction of the house side. The City states that "Los Altos residents are responsible for the maintenance of sewer laterals from their home to the main sewer line, which is typically in the street", and that the owner "is responsible for cleaning and maintaining the street and house lateral all the way to the main sewer, except for reconstruction and repair" - with reconstruction of the length "from the first joint after the property line to the home" also the owner's. Where a contractor cannot clear a stoppage because of a defect, the owner is responsible for the repair unless the defect lies beyond the first full section of pipe past the cleanout.

What else is worth knowing

The handover is a joint in the installed pipe rather than a line on a map - "the first joint after the property line" - so nobody knows exactly where it falls until the trench is open. Two things are worth settling in advance. A property with no accessible cleanout at the property line is outside the City's blockage courtesy, and the City advises installing one if there is none. And the repair test turns on "the first full section of pipe past the cleanout": a defect one section past it is the owner's, further out is the City's. The Maintenance Division is the place to settle either for a particular address. Settle one thing before any of that, though: not every Los Altos address is on the City's sewer. Cupertino Sanitary District states that it serves "portions of ... Los Altos", and where it does the answer is its own - that District maintains as well as repairs the street lateral, again on condition of an accessible cleanout at the property line.

  Los Altos Municipal Code 10.04.310 states that "unauthorized persons shall not uncover, make any connection with or opening into, use, alter, or disturb any public sewer or appurtenance or perform any work on any lateral or building sewer without first obtaining a written permit from the city". Section 10.04.260 adds that where a building sewer "is too low to permit gravity flow to the public sewer", the sewage "shall be lifted by artificial means, approved by the superintendent ... at the expense of the owner". Under 10.04.300 building and lateral sewers "shall be tested in the presence of the superintendent by filling the line with water", with the fittings, plugs, water and labour found by the person constructing the sewer.

  What to do: Ask Public Works whether the work you have in mind needs a written permit before booking a plumber, because the section is written broadly enough to reach work on private ground. If the property sits low, expect pumping to be the owner's cost, and expect the completed work to be water-tested with the superintendent present. First, though, confirm whether the address is on the City's sewer at all - Cupertino Sanitary District serves portions of Los Altos and applies its own requirements there.

  Why this matters▸▾

  The permit sentence has no threshold in it. No valuation, no length, and - unlike the permit rules in Burbank and Merced - no limit to the part in the street: it names any work on any lateral or building sewer. Read as written, that reaches a repair in your own garden. The low-house rule is the fourth version of the same problem BelowGrid has now collected, and the only one with no measurement in it: Milpitas, Burbank and Cupertino Sanitary District each publish a test you can check against a manhole rim, while Los Altos states the physics and leaves it to the superintendent - simpler to read, harder to plan against.
