Who is responsible for which part

The pipe is yours to the main, fitting and all: the code makes each owner responsible for "the entire house lateral up to and including the wye or tee in the city's main line", and defines that lateral as the part "within the street or right-of-way". If nobody can tell where a blockage is, Lancaster will dig to find out - and the answer decides the bill. Fault in the City's sewer is repaired "at no charge to the property owner"; fault in your lateral and you "shall reimburse the city for all costs necessarily incurred".

The property owner

The whole house lateral, including the fitting where it meets the main. Section 13.07.060 provides that "each property owner is responsible for the installation, repair and maintenance of the entire house lateral up to and including the wye or tee in the city's main line", and that each owner "shall keep his/her house lateral in good working order at his/her own expense". The code defines a house lateral as "that part of the sewer piping within the street or right-of-way which extends from the property or sewer right-of-way line to a connection with the main-line sewer" - so the length beneath the road is the owner's, and the City's own duty runs only to "any main line public sewer in a dedicated right-of-way". The owner is also "responsible for damage to any of the city's property comprising any part of the public sewer system which results from the owner's use, repair or maintenance" of it.

What else is worth knowing

Nothing splits the pipe, but Lancaster publishes something better than most: what happens when nobody can tell whose pipe has failed. Section 13.07.060(C) provides that where the location of a malfunction "is disputed or cannot be determined from surface observation", the director may open the street or the main to find out. Then the bill follows the answer. If the fault is in the City's system, "the city shall conduct the repair at no charge to the property owner". If it is in your house lateral, the City "may proceed with the repairs to such house lateral upon notice to the property owner", may "require a written reimbursement agreement executed by the property owner before beginning repair", and "the property owner shall reimburse the city for all costs necessarily incurred". The same subsection declares that "a malfunctioning house lateral is declared to be a public nuisance", which is what gives the City the standing to act without waiting for you. Two practical consequences. Ring the City before you hire anyone, because the investigation is theirs to run and may cost you nothing. And if it does turn out to be yours, ask to see the reimbursement agreement before work starts rather than the invoice afterwards.

Two things follow.
