Who is responsible for which part

In Hercules the service lateral is the owner's, all the way to the City's sewer. Section 5-4.05 of the City's code provides that "The service lateral shall be installed and maintained by the owner of the property served."

What else is worth knowing

Nothing splits the lateral; the main is the dividing point. The part of the lateral under a street or right-of-way is not a public sewer. The code says the lateral ends at the wye, and treats a lateral without a manufactured connection to the sewer as a defect for the owner to fix; it does not say in terms who owns the wye itself.

    What to do: If you are selling in Hercules, check for a certificate issued in the last ten years; if there is none, have a qualified firm inspect the lateral and give the City at least seven days' notice so it can witness it, well before escrow is due to close.

    Why this matters

    A qualified firm makes the video inspection and "All video inspections shall be witnessed by a representative of the City", so the City must be told the time at least seven days ahead; any repairs "shall be completed prior to the close of escrow of the sale". A lateral with a certificate of compliance needs no new test for ten years. A transfer between family members is exempt only where the County Assessor does not require a reassessment, and the City may grant a hardship deferral of repairs.
