- Who issues it:
- City of Dana Point Director of Public Works and Engineering Services
- What it covers:
- breaking the surface of any highway or installing a pipe in or under one, which is where the lateral runs to the main
Dana Point Municipal Code section 14.01.025 makes it unlawful to "dig up, plow up, remove or break the earth, soil, stone, pavement or other surface of, or otherwise injure any highway", or to install a pipe or any other installation "across, upon, in or under any highway without first obtaining a permit therefore from the Director" - the City's Director of Public Works and Engineering Services. Where South Coast Water District collects the sewage, the lateral is the owner's all the way to the main under the street, so this is the permit an owner needs to reach that part of their own pipe. It is the City's permit and applies whichever district collects.

Who is responsible for which part
In Dana Point the sewer lateral is the property owner's to maintain all the way to the main sewer under the street. The City's utilities page says the sewer system in the city "is owned, operated and maintained by the South Coast Water District", and the District's board resolved in March 2000 that "property owners shall be responsible for the maintenance of the sewer lateral line to the point of connection with the District's collector sewer". The District's wastewater page puts it the same way: property owners are responsible for "the entire length of their lateral line from their home or business to where it meets and connects to the sewer main under the street." The District's sewer infographic settles the joint itself: it labels the lateral as the property owner's responsibility and says that includes the connection.
- The property owner
- The whole lateral, from the building to the District's sewer main, including the length under the street and the connection to the main. Section 1 of the District's Resolution 22-99/00 states the policy that "all sewer lateral lines connecting structures to the District's sewer system shall be regularly and adequately maintained by the property owners", and section 2 ends the owner's duty at the point of connection with the District's collector sewer. Under the lateral line in its sewer infographic, the District prints "Property Owner's Responsibility (Includes Connection)".

What to do: Before digging in the street to reach a sewer lateral, apply to the City of Dana Point for a permit, find out whether the street was paved or resurfaced in the last five years, and give the Director at least 48 hours' notice before work starts. If South Coast Water District collects your sewage, tell it about the repair in advance as well - its board asks owners to give notice before any repair or cleaning of a lateral. Keep the permit papers after the job, because the permittee answers for the patch if it settles.
Dana Point Municipal Code section 14.01.025, Excavation, Fills, Obstructions Upon or Injury to HighwayWhy this matters
The notice and the patch are set in the code. Under section 14.01.210, "Not less than 48 hours prior to the commencement of any work covered by this Chapter, the permittee shall notify the Director of the intent to commence work", with a DigAlert identification number obtained before any excavation, and section 14.01.230 has the permittee tell the Director again when the work is finished. Where pavement is removed, section 14.01.370 asks for "a minimum section of 10 inches of asphalt concrete (AC) over compacted subgrade" unless the Director approves otherwise, and "The City does not allow street cuts on streets that have been newly paved or resurfaced for a period of five years unless an emergency to public health and safety exists." The patch stays the permittee's afterwards: if it settles, section 14.01.390 has the permittee repair it, and "If the permittee does not repair the damage within 30 calendar days, the City shall repair the damage and the permittee shall pay to the City the cost". Section 14.01.050 has every applicant indemnify the City and carry liability insurance naming it, and fees are set by council resolution under section 14.01.090. When the offices are closed and a repair cannot wait, section 14.01.030 lets the work go ahead if the permit is obtained "within one day after the office of the Director are first opened subsequent to the date the work occurred".

Your other pipe: the water service line
The drinking water line coming into your property is a separate pipe, run by a separate authority, and who is responsible for it is decided separately. Your sewer lateral is yours to the main, fitting included; your water line stops being yours at the meter.
