  • Before work on the pipe · Permit

    Who issues it:
    City of Cupertino City Engineer
    What it covers:
going upon, over or under any public right-of-way, including excavation, whichever body collects the sewage

Cupertino Municipal Code section 14.08.020 makes it "unlawful for any person to encroach or make or cause to be made any encroachment without first obtaining an encroachment permit from the City Engineer", and section 14.08.010 defines an encroachment to include "going upon, over or under a right-of-way", with excavation or disturbance and the placement or maintenance of any facility among its examples - a pipe is one. The permit is the City's, whichever body collects the sewage, so it reaches any lateral work in the street: an owner connecting the cleanout that Cupertino Sanitary District requires to the lower lateral, or an owner on the City of Sunnyvale's sewer working on the connection under the road.

Who is responsible for which part

The City of Cupertino does not collect sewage itself. It states that it "contracts with external providers for water, sewer, and solid waste operations" and names two for sewer: Cupertino Sanitary District and the City of Sunnyvale. Its General Plan says "The majority of the City is served by the Cupertino Sanitary District". For the District's customers, section 4103 of its Operations Code splits the lateral at the cleanout: where there is a cleanout of four inches or larger, "District will be responsible for maintenance and repair of the lower lateral (from point of connection at the cleanout to sewer main)", and the cleanout and the pipe to the house are the owner's. The City of Sunnyvale collects from a small part of the city, and its own code does not state that split.

What to do: Before digging in the street to reach a lateral, apply to the Cupertino Public Works Department for an encroachment permit and ask whether the street has been resurfaced or resealed in the last three years. Give the City Engineer two full business days' notice before work starts. On Cupertino Sanitary District's sewer, obtain the District's own sewer permit and pay its fees as well - they are separate from the City's. If a pipe has broken, the repair may start first, but give notice within four hours - the City Engineer in business hours, County Communications after hours - and apply for the permit the next business day.
