Who pays for the sewer lateral in Victorville, CA
Which part of the pipe is yours
Yours from your property line to your building
Why, and what to do
If something’s wrong
If a repair needs a permit or an inspection
- Who issues it:
- City of Victorville
- What it covers:
- any repair on a building sewer, and a second right-of-way permit where the work encroaches on the public right-of-way
Victorville requires a permit before a repair, not only before a replacement: "prior to commencing any repair on a building sewer, the property owner must obtain all applicable permits from the city". If the work reaches the street there is a second one - "should repairs to and/or replacement of the Building Sewer line require encroaching in the public right-of-way, the property owner or property owner's agent must obtain a right-of-way permit from the city engineer prior to commencing any such repairs". More broadly, section 10.02.160(b) bars anyone outside the City and the Victorville Water District from altering "any building sewer ... or any other public or private sewer facilities" that discharge into the city sewer system "without first submitting any required plans and obtaining a sewer permit from the city".

Who is responsible for which part
The property line divides the pipe, and the code says so from both directions: the City is responsible for "the sewer lateral line from the sewer main-line or trunk line to the property line", and owners must maintain "at the property owners' sole expense, the building sewer line from their building or structure to their property line". The City's own Maintenance and Repair page says something different in one paragraph - that owners are responsible "from the building to the point where it connects to the City's sewer system" - while listing "Sewer laterals located within the public right-of-way" as the City's in another. The ordinance is what governs, and the ordinance says property line.
- Victorville
- The length in the street, from the main to your property line. Section 10.02.060 makes the City responsible for "the operation, maintenance, repair and replacement of any public sewer main or trunk lines within a dedicated public right-of-way or easement, including the sewer lateral line from the sewer main-line or trunk line to the property line", and the definitions agree: a sewer lateral is "that portion of horizontal piping that located in the public right-of-way that connects a building sewer to a public sewer and is maintained by the city".
- The property owner
- Everything from the building to the property line, and the code is specific about what that means in practice. Section 10.02.070(a) requires owners "to maintain in good working order, at the property owners' sole expense, the building sewer line from their building or structure to their property line", and to "keep the building sewer line free of roots, grease, debris, and blockages, and ... ensure that there are no breaks, cracks or other issues as to prevent the sewer lateral from operating in an efficient manner". The definitions make the same division: a building sewer is "a sewer located on a user's private property ... and is maintained by the property owner".

What to do: Ask the City what permits your job needs before work is scheduled, and ask specifically whether the work will encroach into the public right-of-way, because that is a second permit from the city engineer rather than a box on the first one. If the answer is yes, say so out loud to your contractor and ask which side of the property line the failure is on - and if the honest answer is that nobody can tell, section 10.02.090 lets the city engineer excavate to find out once you have dealt with your own half, and the repair is at no charge to you if the fault turns out to be on the City's length.
Victorville Municipal Code, Title 10 Water, Sewers and Utilities, Chapter 10.02 Sanitary Sewer Use OrdinanceWhy this matters
The word that does the work is "any". This is not a clause about replacing a lateral; a spot repair on a cracked joint in your own front garden is inside it, and plenty of plumbers will not raise the subject. The right-of-way half is worth a second thought for a different reason. In Victorville your pipe stops at the property line and the City maintains the length from there to the main, so a repair on your building sewer should not need to reach the street at all. If a contractor tells you it does, the useful question is not which permit but whose pipe - because the answer may be that the failure is on the City's length and the City's bill.
