Who pays for the sewer lateral in Thousand Oaks, CA

Which part of the pipe is yours

If something’s wrong

If a repair needs a permit or an inspection

  • Before work on the pipe · Permit

    Who issues it:
City of Thousand Oaks - the building official for the pipe, the City Engineer for the right-of-way
    What it covers:
altering or repairing building service equipment, and excavating or placing a pipe within a right-of-way

Two permits and an inspection sequence. Thousand Oaks Municipal Code section 8-4.09 provides that "no building, structure or building service equipment regulated by this code shall be erected, constructed, enlarged, altered, repaired, moved, installed, improved, removed, converted or demolished unless a separate, appropriate application has been made and permit for each ... has first been obtained from the building official". Section 7-2.301 adds the street side: "it shall be unlawful for any person to encroach, or to make or cause to be made any encroachment, or to do any encroachment work upon, over, under, or within any right-of-way in the City without first obtaining a permit from the City Engineer", and encroachment is defined to include "excavating" and "constructing, placing, or maintaining any ... pipe, conduit, or cable on, over, under, or within a right-of-way".

Who is responsible for which part

Thousand Oaks draws its line at the main and says so in one sentence. Section 10-1.407 of the municipal code provides that "the installation, maintenance, repair or replacement of service laterals and other facilities beyond the City's public main shall be solely the complete responsibility of the property owner or property owners association", and that "the City's responsibility shall cease at the public main". The code splits the run in two for naming purposes - a "building lateral" is "the pipe on private property connecting a building with the service lateral on public property at the property line", and a "service lateral" is "the pipe designed or intended to convey wastewater from the building lateral to the public wastewater pipeline" - and then puts both of them on the owner.

What to do: Book both permits before work is scheduled - the building official's and the City Engineer's - and confirm with the contractor that the trench will stay open for two separate inspections rather than one. Give Public Works the twenty-four business hours' notice in writing. If the work will change the lateral's size, depth or position rather than replace it as it was, raise that with Public Works early, because section 10-1.410 makes it a separate approval with its own fees. In a genuine emergency section 7-2.609 allows the work to start, with a written permit applied for on the first working day afterwards.
