Who is responsible for which part
In Tehachapi the whole sewer lateral, from the building to its connection with the City's main, is the parcel owner's to maintain, repair and replace. Section 8.44.020(C) of the City's code provides that "The maintenance, repair and replacement of the lateral shall be the sole responsibility of the parcel owner at the parcel owner's sole cost and expense except as otherwise described herein." The exception is the paving: where the work opens the street, the City pays to replace what is removed.
- The property owner
- The lateral, which the same subsection defines as "the piping from the exterior wall of any building which extends to its connection to a sewer main line by which the wastewater from the building is discharged into the city's sewer system". Every cost of maintaining, repairing or replacing it, including the cleanout at the property line, is the owner's.

What to do: If a lateral repair or replacement will reach under the street or sidewalk, have your contractor apply for the City's encroachment and building permits and submit the cost estimate for approval before booking the work, and include a property line cleanout in the job.
Tehachapi Municipal Code section 8.44.020(C)Why this matters
Two permits and an approved estimate come before the street is opened: the contractor gives the City a cost estimate, which the director of public works approves before any work starts in the right of way. The contractor also installs a cleanout at the property line to the City's subdivision development standards, and the City's building inspector approves the cleanout and the replaced paving. The City pays for replacing the paving, curb, gutter and sidewalk; the cleanout and the rest of the work are the owner's cost.
