The property owner maintains, repairs and replaces the whole lateral, running from two feet outside the foundation wall to the public main and including the connection.

The District states that "it shall be the responsibility of the property owner to perform all required maintenance, repairs and replacement of the private sewer lateral, including backwater valves", and defines that lateral as the piping "from two feet outside the outer foundation wall of the structure to the first encountered publicly owned sewer pipe, including the connection" - so the run beneath the street and the connection at the main are the owner's. Where a lateral serves more than one home, the District places the duty on the homeowners' association or other body responsible for the commonly owned property.
What else is worth knowing
Nothing splits the lateral - the District says twice in its own plan that it "does not own or maintain sewer service laterals", and reports the portion of laterals it is responsible for to the State as none. What is worth knowing is who to ring when the problem turns out to be in the street, because the District's position on Sausalito has changed. Its 2025 sewer system management plan records that the District "has also acquired the 22 miles of gravity sewer previously owned by the City of Sausalito" - so the mains under Sausalito's streets now appear to be the District's. Older District material told Sausalito residents the opposite, that the City looked after mains in its own jurisdiction. At a Sausalito address, ring the District first about anything in the road, and say you are asking because the mains changed hands.

    What to do: Ask Sausalito-Marin City Sanitary District which subsection applies to your project before assuming the $50,000 exclusion covers it, and whether the lateral's age qualifies it.

    Why this matters

    The District excludes remodelling, modification and alteration work costing less than $50,000. It does not name construction in that exclusion, so new construction appears to be covered at any value. Adding a second dwelling unit is treated as a change of use, which carries no threshold at all. A lateral less than ten years old at the date of the permit application may qualify for a certificate without an inspection, on evidence such as a permit showing complete replacement.

    Before title transfers, the seller is to provide a valid compliance certificate to the buyer, both brokers and the escrow holder. A certificate is valid for twenty years after a complete replacement and seven years otherwise. The District defines a title transfer as a sale of the whole estate or fee interest, and specifically not a partial interest such as a leasehold.

    What to do: Ask Sausalito-Marin City Sanitary District whether a current certificate already covers this property, and if it is a condominium or shares a lateral, ask which provision applies before assuming this one does.

    Why this matters

    The District states that this requirement does not affect the legality of the transfer, and that where a certificate cannot be obtained in time the owner may request a conditional certificate giving ninety more days - either by depositing $4,500 into escrow or by agreeing that the District arranges the work and collects the cost on the tax roll. If the work is not finished within those ninety days the District may enter the property, do it, and bill for it. Multi-unit buildings on a shared lateral are handled under a separate provision addressed to the homeowners' association, so a condominium sale may work differently.
