- Who issues it:
- City of Placentia public works director
- What it covers:
- any excavation or opening in a public street, alley or other public place, which is where the lateral runs to the main
Placentia Municipal Code section 14.04.100 provides that "No person shall dig, cut into or make any excavation or opening in any public street, avenue, alley or other public place in the city, without first obtaining from the public works director a permit to do so and making the deposits with the city as provided in this article." The City's lateral runs to the main under the street, so this is the permit an owner needs to reach that part of their own pipe. It is the City's street permit and applies whichever agency collects the sewage.

Where the City of Placentia collects the sewage, the owner maintains the lateral all the way to the City's main under the street. Section 16.12.140 of the Municipal Code provides: "It shall be the responsibility of each property owner to maintain the sewer lateral serving his property in proper working order." Section 16.12.010 defines the sewer lateral as "that portion of the sewer system which extends from the main sewer to the building or structure served", and the main sewer as "a main pipe line sewer of the city laid in the streets, alleys and along the rights-of-way". Part of north-east Placentia is sewered by Yorba Linda Water District instead, and its rules also leave the lateral to the owner, down to the fitting on the main.
- The property owner
- The whole sewer lateral, from the building to the City's main in the street. The code does not say on which side of the joint with the main the owner's part ends. New connections and old ones are the City's to approve: section 16.12.090 provides that "No person shall make or attempt to make any connection with the main sewer lines of the city without first having secured a permit therefor", and under section 16.12.130 no building may be connected to an old sewer "until a permit has been granted for so connecting and a certificate of inspection obtained from the chief building official."

What to do: Before digging in the street to reach a sewer lateral, apply to Placentia's public works director for an excavation permit with a drawing of the trench, and ask whether the street was paved in the last five years or sealed in the last three. If Yorba Linda Water District collects your sewage, get its approval too: its rules provide that "Any modification, rehabilitation, repair, or replacement of the Service Connection requires a District Sewer Connection Permit." Keep the permit papers for at least six months, while the deposit is held.
Placentia Municipal Code section 14.04.100, Permit requiredWhy this matters
Some streets cannot be opened at all for a while. Under section 14.04.340, "On a paved, constructed, or reconstructed street, the pavement surface shall not be cut or opened for a period of five years after the completion date", three years on a sealed street, unless the public works director grants an exception, for example for an emergency. Cutting a street inside that period needs a written waiver under section 14.04.350 and a much larger resurfacing afterwards: on a residential street a cut along the street is repaved or resealed out to the centerline, on a repaved street for 50 feet beyond each end as well, and a cut across it is resealed for 100 feet on either side. For an ordinary permit, section 14.04.120 asks for a written application with a drawing showing "the exact location of the excavations proposed to be made", a deposit set by council resolution is held for six months after the work under section 14.04.160, and section 14.04.150 requires the street to be left "in as good condition as the same was in before such excavation was made", with the City's repair costs taken out of the deposit. Section 14.04.170 sets the depth: any pipe laid under a street must be "not less than three feet from the established grade", or 15 inches on a residential street 44 feet or less from curb to curb.
