Who pays for the sewer lateral in Oceanside, CA

Which part of the pipe is yours

If something’s wrong

If a repair needs a permit or an inspection

  • Before work on the pipe · Permit

    Who issues it:
City of Oceanside, Water Utilities Department
    What it covers:
sewer house connection repairs or replacement where any portion of the work touches, extends into or encroaches upon a public right-of-way, and separately any work at all on the city's sanitary sewer system

Oceanside requires an encroachment permit for lateral work on a test of contact rather than excavation: "an encroachment permit shall be required for sewer house connection repairs or replacement if any portion of the work touches, extends into, or encroaches upon a public right-of-way." Since the code defines a house connection as "the service pipes from the private property line to the public sewer main", the pipe it makes you responsible for is in the right-of-way by definition. Separately, section 29.12.2 provides that "no person shall in any manner whatever meddle, tamper, or interfere with or perform work on any part of the sanitary sewer system of the city without the city's express written permission."

Who is responsible for which part

The sewer lateral is the owner's out into the road. Oceanside's code puts the costs of installing, maintaining, replacing and permitting a house connection on the property owner, and defines that connection as "the service pipes from the private property line to the public sewer main or lateral in a public street, alley or easement" - so the length under the paving is yours. The City says the same in plainer words: "private sewer lines (from the street to your house) are the responsibility of the property owner". Your water line, by contrast, stops being yours at the meter.

What the rules say

Most relevant if you are repairing or replacing the pipe

What to do: Assume you need the encroachment permit and ask Water Utilities early rather than late, because the test is whether any part of the work touches the right-of-way and your lateral starts there. Tell your contractor that nothing may be done to the City's own sewer - including opening a manhole or working back from the main - without the City's express written permission. Ask how the connection at the main must be made: the code points to the City's engineering manual, now published as the Water, Sewer, and Reclaimed Water Design and Construction Manual rather than under the name the ordinance uses, and the standard drawing for a house connection is S-3.
