Who pays for the sewer lateral in Encinitas, CA
Which part of the pipe is yours
Yours all the way to the main under the road — unless Leucadia Wastewater District is your sewer provider
Why, and what to do
If something’s wrong
If a repair needs a permit or an inspection
- Who issues it:
- City of Encinitas Director of Public Works
- What it covers:
- sewer lateral work in the public right-of-way and any other work covered by the right-of-way construction chapter
Encinitas Municipal Code section 18.16.040 states it in one line: "Sewer lateral work in the public right-of-way requires a City permit." The permit is the right-of-way construction permit of chapter 15.04, whose section 15.04.020 provides that "No person or entity shall do or cause to be done any work covered under this chapter without first having obtained a permit, City contract, or City franchise to do such work", issued by the Director of Public Works. The City's sewer code puts the lateral under the street on the owner and lets the owner work on it "only after the required permits have been issued", so this is the permit an owner needs to reach their own pipe.

Who is responsible for which part
Where the City of Encinitas collects the sewage, the owner keeps the lateral all the way to the main, including the length under the street. Section 18.04.100 of the municipal code provides that "The property owner serviced by a sewer lateral shall be responsible for cleaning, maintaining and repairing the sewer lateral between the sewer main and the lateral connection to the structure", and section 18.01.030 defines the sewer lateral as "the service pipes extending from the private property line to the public sanitary sewer main in a public street, alley or easement". Section 18.16.040 adds the cost of building it: "The expense of construction, installation, replacement, and maintenance of the sewer laterals are solely the responsibility of the applicant."
- The property owner
- The whole run from the building to the City's main - the house sewer on the lot and the lateral from the property line to the main under the street or in an easement. The owner cleans, maintains and repairs it, and under section 18.04.100 does so "at the property owner's sole expense and only after the required permits have been issued". Where the City clears an obstruction from a lateral because the work is designated as necessary for public safety, the owner reimburses the City. The main is the City's: a "sewer pipeline in the sanitary sewer system of the City" into which individual service laterals discharge.

What to do: Before digging in the street to reach a lateral, apply to the Encinitas Director of Public Works for a right-of-way construction permit, with a State-licensed contractor, a liability insurance policy and a cost estimate for the security. If the property is in the Coastal Zone, ask whether a Coastal Commission permit or exemption is needed first. If Leucadia Wastewater District collects your sewage, ask the District what it requires as well - its ordinance expects lateral repairs to comply with City right-of-way regulations.
Encinitas Municipal Code section 18.16.040, Cost of Sewer Lateral ConstructionWhy this matters
The security is priced off the job, not set at a flat figure. Section 15.04.100 sets it "in an amount of at least 150% of the approved estimate" of the cost of the work, as a cash deposit, a letter of credit, a lien on the property or another form the Director accepts, and the City may draw on it to finish work left in default. Before any permit issues, section 15.04.120 requires a policy of liability insurance "in an amount satisfactory to the Director of Public Works", kept in force for the full term of the permit. Under section 15.04.110 the work must be done "by a contractor who is appropriately licensed by the State of California to do the work proposed under the permit". Starting without a permit can stop the job and, under section 15.04.035, double the City's processing and inspection fee. Near the shore there is a further step: section 15.04.060 withholds encroachment permits in the Coastal Zone until a Coastal Commission permit or exemption is in hand, except for repairs to single-family homes valued under $7,500 that are not between the mean high-tide line and the nearest improved public street.
