What to do: Find out how old the lateral is before applying for the building permit. Evidence that it is under twenty years old is what turns this from a test into a form.

The way out is the lateral's age. The City states a certificate can be issued on evidence that the lateral is less than twenty years old, or on a plumbing or sewer permit showing it was replaced within twenty years. Without that evidence a licensed contractor must pull a permit and a verification test has to be witnessed by a City inspector, which is time a building project may not have. Berkeley's own interest-free loan will not help: it excludes compliance triggered by a renovation of $60,000 or more.
The City of Berkeley states that a Sewer Lateral Certificate of Compliance is required before close of escrow when a property is sold or transferred, and that this applies to all buildings including condominiums. A certificate held by a previous owner transfers with the property and stays valid until its printed expiry: twenty years from a complete replacement, seven from a spot repair or a passed test.
