If a repair needs a permit or an inspection

  • Any time · Inspection

Stockton's chapter 13.50 applies to privately owned upper sewer laterals "that have caused a reportable sanitary sewer overflow", and requires owners "to test, inspect, maintain, repair and/or replace" them afterwards. The City adds that "all testing, inspection, maintenance, repair and/or replacement must bring the upper lateral to current code requirements". The standards are specific: free of roots, grease and solids; tight joints and sound pipe without cracks, breaks, openings or missing portions; a grade "uniform without sags or offsets"; cleanouts sealed with a proper cap; and all nonsanitary connections disconnected.

Who is responsible for which part

Stockton owns the pipe under the road. Its code defines the lower lateral as "the lateral line owned by the City", running from the sewer main to the back of the public right-of-way, and says flatly that the City maintains it - with no cleanout condition of the kind other cities attach. You keep the run from your foundation to the right-of-way, and if roots from your pipe reach the City's, you have 45 days to deal with it.

What to do: Get the permits before any repair - the City requires them "prior to making any repairs of upper laterals" - and then keep the signed inspection cards somewhere safe. They are worth ten years: a final-inspected City permit covering repair or replacement of the upper lateral "completed within the previous 10 years" is one of only two ways to show the lateral is in satisfactory condition, and the other is a CCTV survey you pay for. If you are told roots from your lateral have reached the City's, treat the 45 days as real and ask about a compliance time schedule if the work cannot be done inside it.
