The property owner is responsible for the whole lateral from the building to the public main, including the wye at the main, whether or not it runs under the street.

The City states the owner "shall be responsible for any portion of the private sewer lateral extending from a building to the public sewer main, including the wye connection which joins the private sewer lateral to the public sewer main", and that repairs, replacement and maintenance - naming "the clearing of pipes using common industry hydro or mechanical cleaning tools" - "will not be provided by the City". The City's sewer-lateral FAQ adds that this holds "whether the private sewer lateral is under a public right-of-way (street) or on private property in an easement" - so the length under the road is the owner's too.

What else is worth knowing

One thing to know if anybody shows you a drawing. The City adopted a new set of Public Works standard drawings in July 2026, and its sewer lateral sheet marks the run either side of the main "OWNER MAINTAINED" and "CITY MAINTAINED" - with the divider drawn at the wall of the main and the wye fitting on the City's side of it. The code says the opposite, and says it expressly: the owner is responsible for the lateral "including the wye connection which joins the private sewer lateral to the public sewer main", and the City's own administrative regulations for the lateral ordinance define a private sewer lateral the same way. An ordinance outranks a construction sheet, which is why this page answers as it does - but the sheet is six weeks old and it is the thing a contractor is most likely to be holding. If a quote turns on who owns the fitting at the main, get the position in writing from Public Works before the trench is open.

  San Mateo Municipal Code 7.38.432(c) states that a sewer lateral inspection is required upon the sale of real property served by a private sewer lateral, that the property owner is responsible for having it done by a licensed plumber or contractor, and that the results must be given to the Public Works Department on the City's inspection form. San Mateo issues no certificate of compliance: the completed inspection form is the record.

  What to do: Ask the City of San Mateo Public Works Department whether an inspection is already on record for this property, and whether the sale trigger applies to a building of this type. If an inspection fails, the code lets buyer and seller negotiate who repairs the lateral; where the buyer takes it on, the City's regulations give them ninety days from the sale.

  The City's administrative regulations implement this trigger only for detached one- and two-family dwellings, while the ordinance text is broader and states that it prevails where the two disagree. Both are set out here, with the difference named, rather than one chosen over the other. Separately, no inspection is required where the lateral was inspected in the five years before the sale with no or only partial repairs needed and those completed, or completely replaced within twenty-five years under a City plumbing permit.
