- Who issues it:
- City of Petaluma, Public Works Director - written permits for excavation in a public street or right-of-way
- What it covers:
- any excavation in or under a public street, alley, sidewalk, other right-of-way or public easement to install, repair or remove any pipe
Petaluma Municipal Code section 13.12.010 requires anyone making "any excavation in or under the surface of any public street, alley, sidewalk or other rights-of-way or public easements for the installation, repair or removal of any pipe" to first obtain written permits from the public works director. The lateral is the owner's "to the sewer main and through the city right-of-way including the connection at the main" (section 15.40.060), so digging to reach it under the street needs one.

Who is responsible for which part
Petaluma puts the whole lateral on the owner, the connection at the main included, and says the owner owns it through the City's right-of-way. Section 15.40.060 provides that "All sewer laterals are owned by the property owner to the sewer main and through the city right-of-way including the connection at the main. All sewer laterals shall be maintained by the property owner to prevent inflow and infiltration."
- The property owner
- The lateral from the building's foundation to the public sewer, the length under the street and the connection at the main included. Section 15.40.080 defines the lateral as "the connecting piping infrastructure, or pretreatment facilities, from the building's foundation to the public sewer system that conveys sanitary sewage from the building to the city sewer".

What to do: Before anyone digs in the street, sidewalk or other City right-of-way to repair, replace or connect the lateral, have your contractor get the permit from Petaluma Public Works - an Encroachment Permit, as the City calls it - with the insurance certificates on file. Tell Public Works at least eight working hours before the excavation starts (the code counts working hours as 8 a.m. to 5 p.m., Monday to Friday, excluding legal holidays) and again when backfilling is to begin, and backfill only under the City's supervision. Agree in writing who carries the one-year guarantee of the street repair.
Petaluma Municipal Code section 13.12.010, Permit requiredWhy this matters
The City says so in its own words for laterals. Its grant page answers whether a replacement needs permits: "Your contractor will need an Encroachment Permit to work in the public right-of-way or when connecting to a public utility." The trench is supervised to the end: section 13.12.070 provides that "All excavations made under this chapter shall be backfilled only under the supervision of the public works director, or authorized representative, who shall cause such backfilling to be inspected during the course thereof", and the permit holder must say when backfilling will start. Section 13.12.080 makes whoever dug answer for the backfill and repair for one year after the City accepts it. Insurance comes first: under section 13.12.190 "No person shall be entitled to permits under this chapter unless" a certificate of public liability and property damage insurance is on file with the public works director, and certificates of workers' compensation insurance or permission to self-insure must be submitted too. Work done by or on behalf of the owner of a single-family residence, appurtenant to it, is spared the special deposit or bond (section 13.12.140), but section 13.12.170 keeps that owner "subject to all other obligations and liabilities of this chapter" - the insurance included, and the director may still require a deposit of anticipated inspection fees under section 13.12.070. An excavation needed for the preservation of life or property may start first, with a permit obtained "within twenty-four hours thereafter" (section 13.12.090).

Your other pipe: the water service line
The drinking water line coming into your property is a separate pipe, run by a separate authority, and who is responsible for it is decided separately. Your sewer lateral is yours to the main, fitting included; your water line stops being yours at the meter.
