Why, and what to do
If something’s wrong
If a repair needs a permit or an inspection
- Who issues it:
- City of Oroville, superintendent of streets
- What it covers:
- tearing up, loosening or removing any part of the surface of any public street or public thoroughfare in the city
Oroville Municipal Code section 12.08.010 provides: "No person shall tear up, loosen or remove any part of the macadam or other surface dressing of any public street or public thoroughfare in the city without having first obtained a permit to do so." Where the City collects the sewage, its code puts the lateral under the street, and the connection to the main, on the owner, so this is the permit an owner needs before opening the street to reach that pipe. It is the City's street permit, so it applies whichever agency collects the sewage.

Who is responsible for which part
Where the City of Oroville collects the sewage, the owner keeps the whole lateral, the connection to the City's main included. Section 13.04.070 provides that "All private sewerage facilities as defined in Section 13.04.010 connected to the city's sewerage facilities shall be maintained by the owners in safe, operable condition and free from excessive infiltration and root intrusion into the city sewerage facilities." Section 13.04.010 defines those private facilities as the privately owned pipes carrying sewage "away from buildings to the city sewer main located in the public right-of-way or a city sewer maintenance easement", and adds: "These facilities include all of the underground sewer lateral pipes and appurtenances located within the city's public right-of-way or a city sewer maintenance easement, and specifically includes the equipment and materials used to physically connect the lateral pipes to the city sewer main, and the portion of the city sewer main the lateral pipes are connected to."
- The property owner
- Everything from the building to the City's main: the lateral on the lot, the lateral under the street or in a City sewer easement, the fittings that join it to the main, and - in the code's own words - "the portion of the city sewer main the lateral pipes are connected to". Section 13.04.070 lets the City test these private facilities from time to time; if it finds one unsafe or subject to excessive infiltration or root intrusion, the owner is notified in writing and must repair it within the period the notice sets, failing which the Director of Public Works may abate it as a public nuisance and lien the property for the reasonable cost of repairs.

What to do: Before opening the street to reach a house lateral, ask the City of Oroville's superintendent of streets for an excavation permit and what deposit it will set, and start the work within 10 days of the permit. Tell the City when the work is finished so it can be inspected.
Oroville Municipal Code section 12.08.010, PermitWhy this matters
The permit costs a deposit and has a short life. The application goes to the superintendent of streets with a written notice and a plan showing the exact location of the work, and a deposit is made "in an amount to be established by the superintendent of streets with the existing cost of resurfacing"; deposits are held for two years after the work is finished and certified. The permit "shall become and be void unless the excavation to be made is commenced within 10 days from the date of the issuance of such permit." When the work is done, the superintendent of streets inspects it "upon due notification from the person so doing the work", and replacing pavement and backfill is done under an inspector whose cost is collected from the person making the excavation. In an emergency after hours, section 12.08.100 lets a person lawfully maintaining a pipe in the street dig first and file the statement, plat and deposit within four hours of the City's offices reopening.
