If a repair needs a permit or an inspection

  • Before work on the pipe · Permit

    Who issues it:
City of Moreno Valley Public Works Department, Construction and Permits Division
    What it covers:
any work that encroaches in the public right-of-way, which is where the lower lateral runs to the main

The City of Moreno Valley says its encroachment permit is needed for work in the public right-of-way, whichever agency collects the sewage. Its Construction and Permits Division "manages permits, provides inspections, and oversees project management of private development and public projects that are within the public right-of-way", and for encroachment permits it "Reviews, issues, and enforces permits for any work that encroaches in the public right of way." Asked "When do I need a permit?", the Division's page answers "Any time work is performed in teh City right-of-way" (the misspelling is the page's). The lower lateral runs in that right-of-way between the property line and the main, so reaching it from the street means applying to the City as well as dealing with the agency that owns the main.

Who is responsible for which part

Two agencies collect sewage in Moreno Valley. The City's MoVal 2040 draft environmental impact report says "Wastewater service in the Planning Area is provided by two agencies: EMWD provides collection and treatment for most of the city", while the Edgemont Community Services District "serves a 430-acre area in the western portion of the city that includes the Edgemont neighborhood". For Eastern Municipal Water District customers the lateral is the owner's pipe all the way to the main: the District's Administrative Code says "All completed Sewer Service Laterals shall remain the property of the Customer", and the length under the street "includes the connection to the Sewer Pipeline". The owner keeps all of it clear, and the District repairs the length under the street at its own expense unless, as the District determines, roots or debris from the property caused the damage or the owner otherwise contributed to it. In the Edgemont district the dividing point is a cleanout at the property line where there is one; without one the owner keeps the whole lateral clear to the main, as set out below.

What to do: Before any digging in the street or sidewalk to reach a sewer lateral, apply to the City of Moreno Valley's Construction and Permits Division for an encroachment permit through the City's online permit portal, and ask which trench and pavement standards apply. Then contact the agency that collects your sewage - Eastern Municipal Water District or the Edgemont Community Services District - because each has its own requirements for work on the lateral. Keep the work inside the hours your permit sets.
