Who pays for the sewer lateral in Indio, CA

Which part of the pipe is yours

  • Sewer lateral

Yours all the way to the main under the road — depends on which district bills your sewer: Valley Sanitary District or Coachella Valley Water District

    Why, and what to do

If something’s wrong

If a repair needs a permit or an inspection

  • Before work on the pipe · Permit

    Who issues it:
City of Indio Director of Public Works
    What it covers:
any encroachment in a public place including entry under a street and placing any facility under it

Indio Municipal Code section 97.005 provides that "No person shall establish or cause any encroachment in any public place unless there has been first obtained an encroachment permit therefor from the Administrative Authority", who is the Director of Public Works, and section 97.003 defines an encroachment as "The entry upon, over, under, or placing any facility upon, across, over or under, or the use of any public place" that interferes with its normal use. Both agencies that collect Indio's sewage put the lateral under the street on the owner, so this is the City permit an owner needs to dig in the street to reach it, whichever agency serves the address.

Who is responsible for which part

Two public agencies collect Indio's sewage, each in its own part of the city, and both put the whole lateral on the property owner, from the building to the sewer main. Valley Sanitary District collects in "much of the City of Indio", and its ordinance says that private sewer laterals "are owned by the owner of the property receiving service through said lines". Coachella Valley Water District collects in the rest that is sewered, and says that "Property owners are required to maintain the entire length of the Private Sewer Lateral, which extends from the property to the sewer main located in the street or a nearby easement."

What to do: First confirm which agency serves the address - Valley Sanitary District or Coachella Valley Water District - and meet that agency's own permit and contractor requirements. Then apply to the Indio Public Works Department for an encroachment permit before any work in the street, and give Public Works 24 hours' notice before the work starts. If a blocked or broken lateral cannot wait, the work may start first, but apply for the permit on the first working day after it begins.
