Buying or selling?
Eureka requires the lateral to be inspected when a property changes hands. Section 50.202 provides that every gravity sewer lateral, "including all pipes and appurtenances from the building envelope to the public main", is to be "inspected and repaired/replaced at the property owner's expense" on a list of triggering events, the first being "Whenever any real property located within the city is to be sold, transferred or vested in any other person or entity." Section 50.206(B) states the sale requirement again, but only where the property "contains any building constructed more than 25 years prior to the date of sale", so a newer building may be outside it. The code does not reconcile the two, and this page reports the requirement for every sale.

Who is responsible for which part
In Eureka the property owner is responsible for the whole sewer lateral, from the building to the City's main, including the part under the street. Section 50.092(A) of the City's code makes the customer "responsible, regardless of the cause, for all required repairs to the building sewer line and all other sewer pipe(s) and appurtenances", including the Y cleanout and "the sewer lateral including that portion of the lateral that lies within the public right-of-way."
- The property owner
- The building sewer line, the Y cleanout and its connections, and the sewer lateral, which section 50.002 defines as "The sewer line beginning at the perimeter of any building and terminating at the sewer main". The City's sewer lateral page puts it plainly: "Blockages occurring anywhere in the lateral are the responsibility of the property owner".

What to do: If you are selling in Eureka, check whether the City issued a lateral certificate, or approved a new or replacement lateral, in the last 25 years, and whether the transfer is a family transfer the County Assessor exempts from reassessment. If neither exception applies, book a CCTV inspection by a certified plumber and apply to the City for a sewer lateral certificate well before escrow is due to close.
Eureka Municipal Code section 50.202(A), Triggering eventsWhy this matters
The inspection runs all the way to the main, under the street as well as on the lot, and the owner pays for any repair or replacement it shows is needed. Section 50.206(B)(2) adds that "Upper laterals must be replaced prior to sale." For the lower lateral under the street the owner may pay the City a fee instead of repairing it, but that fee "satisfies the requirement to repair/replace the lower lateral only". Section 50.209 lists exceptions: a City lateral certificate, or City-approved installation or replacement of the lateral, in the previous 25 years with no evidence of a defect or changed conditions; inspection that is physically impossible; piping under ten feet long where the City determines inspection is unnecessary; and transfers the County Assessor exempts from reassessment that are solely between spouses, registered domestic partners, parents and children or grandparents and grandchildren, or that result from a co-tenant's death. Section 50.202 also excuses a lateral and clean-out shown to be less than 25 years old and inspected under a City permit. The City's sewer lateral page also says "All Clay laterals are deemed defective and require replacement with modern materials, regardless of condition." The City may offer loans or grants.
