Who pays for the sewer lateral in El Segundo, CA
Which part of the pipe is yours
Yours all the way to the main under the road
Why, and what to do
If something’s wrong
If a repair needs a permit or an inspection
- Who issues it:
- City of El Segundo Street Superintendent for the right of way permit, with the sewer connection permit from the Public Works Director
- What it covers:
- any work or encroachment in the public right of way, which is where the City's code puts the house connection sewer
El Segundo Municipal Code section 9-2-1 provides that "a permit shall be required for any work or encroachment in the public right of way", and section 9-2-7 that "No person shall dig in, excavate, tear up, deface or injure any street without an express written permit to do so". The City's sewer code defines the house connection sewer as the piping within the street or public right of way and puts it on the owner, so any repair to it is work in the right of way. A new connection or tap needs a sewer permit as well, and section 12-3-1 will not issue one unless a right of way permit is also obtained where one applies.

Who is responsible for which part
El Segundo puts the lateral under the street on the owner, in its own code. Section 12-1-8 provides that "All house connection sewers, house sewers, industrial connection sewers" and other private sewer facilities "shall be maintained in good operating condition and in conformity with applicable law by the owner of the property which such facilities serve", and section 12-1-2 defines the house connection sewer as "That part of the sewer piping within the street or public right of way which extends from the house sewer to a connection with the public sewer". The length the City names first is the length under the road.
- The property owner
- Both pipes the code names between the building and the main. The house sewer is the piping "beginning two feet (2') from the exterior wall of a building, structure or foundation and extending to its connection with the house connection sewer", and the house connection sewer carries on under the street to the public sewer, which section 12-1-2 defines as "A main line sanitary sewer, dedicated to public use and owned by the City." Section 12-1-8 puts both on the owner of the property served.

What to do: Before opening the street to reach a house connection sewer, apply to the City of El Segundo for a right of way permit, and have the bond and the insurance certificate ready, since the permit will not issue without them. If the job includes a new tap into the main, use a licensed sewer contractor and arrange the sewer connection permit and the inspection at the same time.
El Segundo Municipal Code section 9-2-1, Work in public right of way; permits, fees and depositWhy this matters
The paperwork carries money and cover beyond the fee. Section 9-2-1 sets the permit fee by council resolution and adds "a cash deposit sufficient to cover the cost of inspection", with any unused part refunded. Section 9-2-2 withholds the permit until the applicant "has given the City a good and sufficient bond", indemnifying the City against damage and the cost of restoring the street, and section 9-2-3 asks for proof of general liability and workers' compensation insurance with the City named as additional insured. Starting first is priced: where work begins before the permit, "a special investigation fee shall be charged which shall be double the normal permit fee for the work". A tap into the main is made only by a licensed sewer contractor, in front of the City's inspector.
